For some reason, my husband and I were nervous about the meeting today with the BK lawyer. It was a “butterflies in the stomach” type feeling and I don’t know why. We should really have nothing to be nervous about-we have nothing to lose and everything we filled out was all 100% truthful…I guess we were just so anxious. This is a big deal.

So we get to the lawyers office and we actually met with the paralegal to do the intake and go over ALL the paperwork. It was a lot of paperwork. Then the inevitable came, they had to pull our credit report. Something we have not done and not wanted to do since we went through the short sale. Both of our credit scores were 478. Yeah, I know…LOW but I actually thought it would be a lot lower. It was kind of weird-we were people that always were on top of our credit and anything under 750 was bad back in the days for us. 478 looked good actually-considering we have not paid on any cards in over 1 year!

You know another reason why it looked good? Because the better the credit rating-the more credit you qualify for and I just don’t want any-not now..not ever! As far as better rates on car insurance and all that for having good credit-time will tell.

As the paralegal went through our credit report-she was going and going and reading away. She then told us “you guys have a lot of credit”. This is something she deals with all day and for her to say it-I knew then we had more than the average person. When it all was tallied up-it totaled up to over $154k with the car! Of course this is with all the late fees and over-the limit stuff too I am sure. Looking at this paperwork reminds me of where I never want to be-again!

So the paperwork is pretty much done now-we do need to return with a copy of our 2008 tax return which we have not done yet because my husband is waiting on 1 stupid 1099. I have everything ready to go so once he gets it-I just need to put in the #’s and file. Gotta love Turbo Tax!

In the meantime, my husband and I both were given an online login and password to take a 90 minute credit counseling class. Yeah, we each have to sit 90 minutes and do it. Then we call a counselor and talk to them in order to get our Completion Certificate. For how long-who knows? We need to do this within 2 weeks. Once we get the Certificate-we go back to the attorney and I am assuming that is when we actually file. We will not wait the 2 weeks though-we are going to do it tonight. That way we will have that ready and then the 1099 should be here-we will have our taxes done and we can go back ASAP. I want to get this over with already.

Well, one good sign is that the ball is rolling and the lawyer is paid off. I have a little less stress not having to worry about that.

The one thing I will say, as we were sitting in the office waiting-the phones were ringing off the hook! I couldn’t help but hear some of the conversations going on. The most common topic there was: I am losing my house-how do I stop it? It is a sad thing-a real sad thing. I am happy we sold our home when we did even if we made nothing. I would hate to lose it like most of these people are. Some lady even had a sale date she was trying to stop. Sitting there listening to this stuff-you realize…things could always be worse. We will get through this and bounce back. I just hope others out there are able to as well.

So are you filing 7 or 13? how much did you have to pay the lawyer all together?

  2. girlndebt says:

    We are filing Chapter 7.

The attorney fees were $1400 and another $500 for the court costs. It took long enough but we finally paid it all off. Luckily this attorney let us pay off the balance a little every month.

congradulations! I myself ended up using a excellent debt settlement company though. Being in debt stinks and it stinks to have to deal with it when its over you feel like a brick has been lifted off your chest. I try to seek out people in need to let them know there is help out there. Glad to see others are too!
